Privacy Policy

1. Information We Collect

We collect information in three main ways: (1) you give it to us, (2) it's generated while you use the app, (3) we receive it from third-party services you connect.
 

1.1 Account Registration & Profile

When you create an EQlibrium account, we may collect your name or display name, email address, password or auth token (e.g. Apple/Google sign-in), your date of birth — which we use once to confirm you meet our minimum age requirement and do not retain (see Section 8) — and your preferred language and region. You may also add optional profile details such as a profile image or avatar, pronouns, and coaching or role preferences.
 

1.2 Conversation & Practice Data (AI roleplay)

EQlibrium is built around conversations, so we collect data necessary to run those sessions, including audio captured during practice sessions, transcripts of what you say, your typed messages or selected responses, scenario choices, and EQ scores and feedback generated for you (e.g., clarity, empathy, assertiveness). Your name may be used within a roleplay so that characters can address you directly.
 

We send that content to third-party AI service providers to understand what you said, generate realistic responses, analyze tone and communication patterns, and provide feedback and scores. Section 4.1 describes exactly what data is sent, to which categories of provider, and for what purpose. Before we first send your practice-session content to these providers, the app tells you what will be shared and with whom, and asks for your permission.
 

Separately from the processing described above, EQlibrium may use practice content to improve our own service. Where possible, we remove or avoid using directly identifying fields before using content for training or product improvement, including where a model is trained, fine-tuned or evaluated for EQlibrium by a service provider acting on our behalf and under our instructions. This is our own use of the content; it is distinct from our AI service providers, who are prohibited from using your content to train or improve their own general-purpose models (see Section 4.1). We do not use your voice to build generic voice cloning models.
 

Biometric identifiers / voiceprints. We do not use your audio to identify you, and we do not create, collect, store, or use a "voiceprint" or other biometric identifier or biometric information as those terms are defined under applicable law (including the Illinois Biometric Information Privacy Act). Our tone and communication analysis operates on transcripts and general acoustic features and is not used to build a biometric template.

1.3 Technical & Usage Data

When you use the Service, we automatically collect device information (device model, OS, app version), log information (screens viewed, taps, session duration, feature use), IP address and approximate (city/region-level) location, and crash reports and error logs.

1.4 Cookies, SDKs & Analytics

On the web and in the app we may use cookies, local storage and third-party SDKs to keep you logged in, remember your preferences, measure engagement and performance, and diagnose technical issues. Where required by law, we'll present a consent banner and let you manage your preferences.
 

1.5 Purchases & Subscriptions

EQlibrium may offer paid subscriptions or one-time purchases. Where offered, these are handled through the Apple App Store or Google Play Store. We do not receive your full payment card details. We may receive limited information related to purchase status, subscription dates and country/store region.

1.6 Support & Communications

When you contact us, we collect your name, email, the content of your message and any attachments. We use this to respond and track support history.

2. How We Use Your Information

We use your information to create and maintain your account, run AI-powered practice sessions, track your progress and EQ scores, personalize your experience, communicate with you, keep the Service safe and secure, comply with law, and — using aggregated, anonymized or de-identified data — conduct research and product development. Legal bases include performance of a contract, legitimate interests, legal obligations, and consent where required. EQlibrium does not currently use third-party targeted advertising; if that changes, we will update this Policy and obtain any required consents.

2.1 Automated Processing and EQ Scores
EQlibrium uses automated processing to generate your EQ scores and practice feedback. After a session, our systems analyze your transcript and general acoustic features — such as pacing and emphasis — to produce indicative scores in areas including clarity, empathy, assertiveness, solutions and consistency, along with written feedback and suggested next scenarios.

These scores are educational feedback on communication practice. They are not an assessment of your personality, mental health, or fitness for any purpose, and they are not used to make decisions that produce legal or similarly significant effects about you. We do not use them to determine eligibility for employment, credit, insurance, housing, or any other benefit, and we do not disclose them to employers or other third parties for those purposes.
 

You can view your scores in the app, and you may contact privacy@eqlibrium.ai to ask how a score was generated, to submit observations, or to request correction or deletion of your practice history.

3. Sensitive & Consumer Health Data

Some information you provide or that we generate — such as emotionally sensitive conversation content and EQ scores relating to communication and emotional skills — may be treated as "sensitive personal information" or "consumer health data" under laws such as the California Privacy Rights Act, the Washington My Health My Data Act, the Nevada consumer health data law, and as "sensitive information" under Quebec's Law 25. We use this information only to provide and improve the Service, obtain your express consent where required, do not sell it, and do not share it for cross-context behavioral advertising. Where a specific consumer-health-data authorization is required, we will request it separately before collecting or sharing that data.

4. How We Share Your Information

We do not sell your personal information. We share it with service providers (cloud hosting, analytics, email tools, payment processors) under contract; with the AI service providers described below; when reasonably necessary to comply with law or protect rights and safety; and in a merger, acquisition or asset sale, subject to this Policy. We require every third party with whom we share personal information — including the service providers and AI service providers described below, and any parent, subsidiary, or affiliated entity that receives user data — to provide the same or an equivalent level of protection for that data as this Policy requires, and to use it only for the purposes we authorize.

4.1 AI Service Providers

To deliver core features — AI-driven roleplay conversations, speech recognition, spoken responses, and tone analysis — EQlibrium sends practice-session content to third-party AI service providers in the following categories:
 

  • Speech-to-text providers receive the audio you speak during a practice session, solely in order to transcribe it into text in real time.

  • Conversational AI providers receive your session transcript, your typed messages, the scenario context, and your first name or display name, solely in order for AI characters to respond, address you by name, and generate your feedback and EQ scores.

  • Voice synthesis providers receive the text of the AI character's responses, solely in order to convert that text into spoken audio.


We send only the data necessary for these functions. We do not send your email address, password or authentication credentials, date of birth, or payment information to any AI service provider.


Your content is used solely to generate a response to you. Our AI service providers are contractually prohibited from using your content to train or improve their own general-purpose AI models, and from using your identifiable data for their own advertising, profiling, or any other purpose of their own. This does not restrict work a provider performs for EQlibrium, on our instructions and on our behalf, as described in Section 1.2.
 

Each AI service provider is contractually required to protect your data at a level equal to or greater than this Policy requires, and to use it only to provide these services to EQlibrium.
 

Consent. Before your first AI practice session, the app tells you what data will be shared and with what type of provider, and asks for your permission before any data is sent. You can request the identity of our current AI service providers at any time by emailing privacy@eqlibrium.ai. We may add, remove, or replace providers within the categories above as our technology changes; the categories of data described in this Section will not expand without an update to this Policy.

5. International Data Transfers

EQlibrium is based in the United States. If you are located outside the US, your information may be processed in countries with different data protection laws. Where required by law, we rely on Standard Contractual Clauses or other lawful transfer mechanisms, including for transfers to the AI service providers described in Section 4.1. Contact privacy@eqlibrium.ai with questions about cross-border data transfers.
 

Canadian users. If you are located in Canada, your personal information is transferred to, stored in, and processed in the United States by EQlibrium and by the service providers described in Section 4. While outside Canada, your information may be accessible to courts, law enforcement, and national security authorities of that jurisdiction under its laws. We assess our service providers before transferring personal information outside Canada and require them by contract to provide protection equivalent to that required under applicable Canadian and Quebec law.

6. Data Retention

We retain personal information for as long as necessary to provide the Service, maintain your account, fulfill legal obligations and resolve disputes. Account information and EQ history are kept until you delete your account or it becomes inactive; certain logs may be retained longer for legal or security purposes; anonymized data may be retained indefinitely.

We do not store recordings of your voice. Audio from a practice session is transcribed in real time and is not retained after the session.

We do not store your date of birth. It is used once to verify your age and then discarded; we retain only a record that verification occurred.

7. Your Rights & Choices

Depending on where you live, you may have the right to access, correct, delete, restrict, port or object to processing of your personal data, and to withdraw consent where we rely on it. You can exercise many rights directly in the app; for other requests, email privacy@eqlibrium.ai. If you are in the EU/EEA or UK, you also have the right to lodge a complaint with your local data protection authority.

7.1 United States — State Privacy Rights (California and Other States)

If you are a resident of California or another U.S. state with a comprehensive privacy law, you may have the right to know and access the personal information we collect, to delete it, to correct it, to obtain a portable copy, to opt out of any "sale" or "sharing" of personal information and of targeted advertising, and to limit the use of sensitive personal information. We do not sell your personal information or share it for cross-context behavioral advertising. We will not discriminate against you for exercising these rights. To exercise them, email privacy@eqlibrium.ai; you may use an authorized agent, and you may appeal a denied request by replying to our decision. We will verify requests as required by law.
 

7.2 Canada — PIPEDA and Quebec Law 25

If you are located in Canada, your personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), applicable provincial privacy legislation, and — if you are a Quebec resident — the Act respecting the protection of personal information in the private sector, as amended by Law 25.

 

Consent. We collect, use and disclose your personal information with your knowledge and consent. Because practice-session content and EQ scores are sensitive information, we ask for your express consent before collecting that content and before sending it to the AI service providers described in Section 4.1. You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice; withdrawing consent to AI processing means we can no longer provide practice sessions, and you may delete your account at any time.

 

Your rights. You have the right to access the personal information we hold about you, to request correction of inaccurate or incomplete information, to withdraw consent, and to make a complaint about our handling of your information. Quebec residents also have the right to receive the computerized personal information they provided to us in a structured, commonly used technological format, and to request that we cease disseminating information or de-index a link where the law provides for it.

 

Automated processing. As described in Section 2.1, EQlibrium generates EQ scores and feedback using automated processing. We do not use this processing to make decisions about you based exclusively on automated means that produce legal or similarly significant effects. If that ever changes, we will notify you at the time of the decision and give you an opportunity to submit observations and request a review by a person.

 

Transfers outside Canada. See Section 5 for information about the transfer of your personal information to the United States.

If you are not satisfied with our response to a privacy concern, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca, or, if you are a Quebec resident, the Commission d'accès à l'information du Québec at cai.gouv.qc.ca.

8. Children & Younger Users

EQlibrium is intended only for users who are at least 18 years old.

Before you can use the Service, we ask you to enter your date of birth to confirm you meet this requirement. If you indicate you are under 18, you will not be permitted to create an account or use the Service. We use your date of birth solely for this check and do not store it — we retain only a record that your age was verified.

We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it. If you believe a minor has provided us information, contact privacy@eqlibrium.ai.

9. "Do Not Track" & Similar Signals

EQlibrium does not currently respond to Do Not Track signals, as no widely accepted standard exists. We will honor applicable opt-out preference signals (such as Global Privacy Control) where required by law.

10. Third-Party Links & Services

The Service may link to third-party websites or services. We are not responsible for their privacy practices. Review their policies before sharing personal data.

11. Changes to This Privacy Policy

We may update this Policy to reflect changes in the Service or applicable law. Material changes will be communicated via in-app notice or email. Continued use after changes take effect constitutes acceptance. 

Non-material updates — such as a change to the specific service providers we use within a category already disclosed in this Policy — take effect immediately upon posting, and the current provider list will be updated as described in Section 4.1.
